Terms of Service

Effective Date: 23 May 2026

Please read these Terms of Service ("Terms") carefully before using the BookCubicle platform. By accessing or using any part of BookCubicle (the "Platform"), you agree to be bound by these Terms. If you do not agree, you must stop using the Platform immediately.

1. Introduction & Acceptance

Welcome to BookCubicle, an online reading platform that connects writers and readers. These Terms form a legally binding agreement between you and BookCubicle ("we", "us", or "our"). They apply to all users of the Platform, including unregistered visitors, registered Readers, Writers, and Team members.

By accessing or using the Platform — including reading content, posting comments, registering an account, or making any purchase — you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy, which is incorporated herein by reference.

2. Changes to These Terms

We may update these Terms from time to time to reflect new features, legal requirements, or operational changes. For material changes, we will provide at least 30 days' advance notice by posting the updated Terms on the Platform and updating the Effective Date above. For minor or non-material changes, the updated Terms take effect immediately upon posting.

Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of those changes. If you disagree, you should stop using the Platform before the changes take effect.

3. Eligibility & Account Registration

Age requirement: You must be at least 13 years old to create an account. If you are under the age of majority in your country, you may only use the Platform with the consent and involvement of a parent or legal guardian. By registering, you represent that you meet these age requirements.

Accurate information: You must provide accurate, current, and complete information during registration and keep it up to date. Misrepresenting your identity is prohibited.

One account per person: Each person may register only one account. Creating multiple accounts to bypass restrictions, earn extra benefits, or abuse any feature is prohibited.

Account security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

Account types: At registration you choose a role — Reader (access and read content) or Writer (publish books and chapters). You may not self-assign privileged roles such as Admin, Moderator, or TeamLeader; those are granted by the platform.

4. User Roles & Responsibilities

BookCubicle operates a role-based permission system:

  • Reader: May browse, read free chapters, subscribe to paid chapter packages, post reviews and comments, follow authors, and manage personal reading goals and collections.
  • Writer: Has all Reader rights plus the ability to create, publish, and manage books and chapters, define chapter pricing packages, approve reader subscriptions, and manage earnings.
  • TeamLeader: Automatically assigned when a Writer creates a team. Manages the team, its members, and the team's books. Reverts to Writer when the team is disbanded or leadership is transferred.
  • Moderator: Admin-granted. May moderate content (reviews, comments) and manage user account status. Cannot grant roles or delete accounts.
  • Admin: Full platform access, granted only by the BookCubicle team.

Each user is fully responsible for all actions taken under their account and for any content they submit to the Platform.

5. Content Policy & Community Guidelines

BookCubicle is a reading community. To keep it respectful and safe:

  • Do not post content that is harassing, threatening, hateful, or discriminatory on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
  • Do not doxx other users — sharing personal information about another person without their consent is strictly prohibited.
  • Do not spam: do not post repetitive, off-topic, or unsolicited commercial messages.
  • Do not impersonate another user, author, or BookCubicle staff member.
  • Do not post content that is pornographic, promotes illegal activity, or contains malicious code.
  • Reviews and comments must reflect genuine opinions. Coordinated review manipulation is prohibited.

We may remove any content that violates these guidelines at our discretion.

6. Intellectual Property & Writer Content

Platform content: All platform-owned content (interface, design, logos, and non-user-generated text) is protected by applicable intellectual property law. You may not reproduce or distribute it without our prior written permission.

Writer content — ownership: Writers retain full copyright ownership of original works they create and upload to the Platform.

Licence to BookCubicle: By uploading any content (books, chapters, cover images, reviews, comments), you grant BookCubicle a worldwide, non-exclusive, royalty-free licence to display, distribute, and promote that content on the Platform for as long as it remains published. This licence ends when you remove the content, subject to any cached or archived copies we may retain for technical reasons.

Translated works: BookCubicle supports multilingual content. If you upload a translation of another author's work, you represent and warrant that you hold the necessary rights to create and distribute that translation. BookCubicle does not verify translation rights and bears no liability for copyright infringement arising from unauthorised translations. You bear full legal responsibility for any such infringement.

User-generated content (reviews, comments): You retain ownership of reviews and comments you post. By posting, you grant BookCubicle the same display licence described above.

No AI/ML training: You may not use Platform content to train, fine-tune, or improve artificial intelligence or machine learning models without our prior written consent.

7. Copyright Infringement Procedure

BookCubicle respects intellectual property rights and adopts a notice-and-takedown process consistent with international best practice, including the principles of the U.S. Digital Millennium Copyright Act (DMCA), on a voluntary basis under Myanmar law.

To submit a takedown notice, send a written notice to [email protected] containing:

  1. Identification of the copyrighted work you claim has been infringed.
  2. Identification of the infringing material on the Platform (include the full URL).
  3. Your contact information (name, address, phone, email).
  4. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.
  6. Your physical or electronic signature.

Upon receipt of a valid notice, we will promptly remove or disable access to the reported content and notify the uploader.

Counter-notice: If you believe your content was removed in error, you may submit a counter-notice to [email protected] containing:

  1. Identification of the removed material and its prior URL on the Platform.
  2. A sworn declaration that the removal was a mistake or that you hold the necessary rights to the content.
  3. Your consent to the jurisdiction of the courts of Myanmar for any dispute arising from this counter-notice.
  4. Your contact information and signature.

We will restore the content within 10–14 business days of receiving a valid counter-notice, unless the original rights holder notifies us that they have initiated legal proceedings.

Repeat infringer policy: We will permanently terminate the accounts of users who receive three or more valid and upheld takedown notices within any rolling 12-month period.

8. Prohibited Activities

In addition to the community guidelines above, you must not:

  • Use any automated tool, bot, spider, or scraper to extract content or data from the Platform.
  • Upload or submit fraudulent payment proof images.
  • Create multiple accounts to bypass subscription requirements or any other restriction.
  • Attempt to gain unauthorised access to any user account, our servers, or our databases.
  • Introduce viruses, malicious code, or any harmful software.
  • Attempt SQL injection, XSS, or any other technical attack on the Platform.
  • Redistribute, mirror, or republish Platform content on any external website or service without our written permission.
  • Use the Platform for any purpose that violates any local, national, or international law or regulation.

9. Subscriptions & Payment Terms

How paid access works: Writers may define chapter pricing packages. Readers purchase access by:

  1. Selecting a chapter package and creating a subscription (status: Pending).
  2. Transferring payment directly to the Writer via an agreed method (e.g., bank transfer) and uploading a payment proof image to the Platform.
  3. Waiting for the Writer to review and approve or reject the subscription.
  4. Upon approval, gaining access to the subscribed chapters.

BookCubicle is not a payment processor. We do not hold, process, or guarantee any payment between a Reader and a Writer. All financial transactions occur directly between the Reader and the Writer. BookCubicle bears no liability for failed, disputed, or fraudulent payment proofs.

Platform billing fees: Writers may be charged publishing or hosting fees by BookCubicle. These fees are separate from reader-to-writer payments and follow the same payment-proof workflow. Non-payment of platform fees may result in content being unpublished or the Writer's account being suspended.

Refunds: Subscription payments are non-refundable once approved by the Writer, except where required by applicable law or in cases of Writer fraud. BookCubicle has no authority to issue or compel refunds on behalf of Writers.

10. Teams & Collaboration

Writers may form collaborative teams subject to the following rules:

  • Each team may have a maximum of 10 members.
  • Each Writer may belong to only one team at a time.
  • The Writer who creates a team is automatically promoted to TeamLeader. On disbanding the team or transferring leadership, they revert to Writer.
  • All team members share responsibility for the content of team-owned books. Any violation of these Terms by a team-owned book may result in action against all team members.
  • Leadership may be transferred by the current TeamLeader. The outgoing leader reverts to Writer; the incoming leader is promoted to TeamLeader.

11. Moderation & Enforcement

BookCubicle enforces these Terms through a progressive process:

  1. Warning: A notification explaining the violation for first or minor offences.
  2. Content removal: Specific violating content is deleted.
  3. Temporary suspension: Account access is restricted for a defined period.
  4. Permanent ban: Account is permanently terminated for severe or repeat violations.

Serious violations (technical attacks, fraud, repeat copyright infringement, uploading illegal content) may result in immediate permanent termination without prior warning.

Appeals: You may appeal an enforcement action by submitting a Support ticket. Appeals are reviewed within 48–72 business hours. Decisions on technical abuse and illegal content are generally final.

12. Service Availability & Modifications

We strive for high availability but cannot guarantee uninterrupted service. The Platform may be temporarily unavailable due to maintenance, upgrades, or unforeseen technical issues. We are not liable for any loss caused by service interruptions.

We reserve the right to add, modify, or remove features at any time. For significant changes we will endeavour to notify users in advance, but this is not always possible. Continued use of the Platform after a change constitutes acceptance of the change.

Data backup: You are responsible for maintaining copies of any content you wish to preserve. We are not liable for any loss of content.

13. Disclaimers of Warranty

The Platform and all content are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no warranty regarding the accuracy of any translation, the completeness of any book, or the suitability of any content for any purpose. Use of the Platform is at your own risk.

14. Limitation of Liability

To the fullest extent permitted by applicable law, BookCubicle and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.

Our total cumulative liability to you for all claims arising from your use of the Platform shall not exceed the total fees you have paid to BookCubicle in the twelve (12) months immediately preceding the event giving rise to the claim. If you have paid no fees, our liability is limited to the equivalent of USD 50.

15. Indemnification

You agree to indemnify, defend, and hold harmless BookCubicle and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) any content you upload or post; (c) your violation of these Terms or any applicable law; or (d) your infringement of any third party's rights.

16. Governing Law

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the Republic of the Union of Myanmar, including the Myanmar Copyright Law (2019), without regard to conflicts of law principles.

Any disputes not resolved informally shall be subject to the exclusive jurisdiction of the courts of Myanmar. We encourage you to contact us before initiating any legal proceedings — most issues can be resolved through direct communication.

Nothing in these Terms prevents us from seeking injunctive or other equitable relief in any jurisdiction to protect our intellectual property or the security of the Platform.

17. Termination

By you: You may delete your account at any time via Account Settings. On deletion, your access ends immediately. Some data may be retained for legal and financial record-keeping purposes as described in our Privacy Policy.

By us: We may suspend or permanently terminate your account at our discretion for violation of these Terms, fraudulent activity, or if we discontinue the Platform. Serious violations may result in immediate termination without notice.

Effect on subscriptions: Upon account termination, any active subscriptions are cancelled. No refunds will be issued for the unused portion of any subscription, except as required by applicable law.

Survival: Sections 6, 7, 13, 14, 15, and 16 survive termination of these Terms.

18. Miscellaneous

Severability: If any provision of these Terms is found unenforceable, it will be modified to reflect the parties' intent as closely as possible, and the remaining provisions remain in full force.

No waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BookCubicle regarding your use of the Platform and supersede all prior agreements.

No third-party beneficiaries: These Terms do not create any rights in third parties.

Force majeure: We are not liable for any delay or failure caused by circumstances beyond our reasonable control, including natural disasters, war, power outages, or internet disruptions.

Assignment: We may assign our rights and obligations under these Terms to any successor entity. You may not assign your rights without our prior written consent.
